Terms & Conditions
About these terms
These terms apply to every order you place on the Batch & Thyme website. By paying for an order you agree to them.
Batch & Thyme is run by Frances Robinson, trading as Batch & Thyme, [business address], Balcombe, West Sussex. You can contact us at [email address] or [phone number].
We mainly supply boxed catering to businesses in Crawley, Gatwick and Manor Royal. If you are buying as an individual, not for a business, nothing in these terms takes away your legal rights as a consumer.
Ordering
An order is accepted when you have paid and we have sent you a confirmation email. Until then it is not a contract.
Minimum order: £100 before VAT and delivery.
Notice: we need at least two working days' notice. The site only offers delivery dates that meet this.
Numbers: bundles are ordered per person, with a minimum of 10 people. Other products are ordered per item.
Accuracy: please check the order summary, delivery address and date before you pay. Tell us straight away if anything is wrong, and we will correct it where we can.
Prices and payment
Prices: shown in pounds sterling, [excluding / including] VAT. VAT is added at checkout where it applies [delete if not VAT registered].
Delivery fee: shown straight after you confirm your postcode, and added to your total. [VAT treatment of the delivery fee: confirm with your accountant.]
Free delivery: on orders over £300 before VAT, in every delivery zone.
Payment: in full at checkout, by card, through [payment provider]. We never see your card number.
Price changes: the price you see when you pay is the price you pay. We may change prices for future orders at any time.
Delivery
We deliver Monday to Friday. You choose a delivery date and time slot at checkout, and the slot is confirmed when you pay.
The delivery fee depends on the straight-line distance from our kitchen in Balcombe to your delivery postcode:
Zone 1: up to 10 miles, £15.
Zone 2: over 10 and up to 15 miles, £20.
Zone 3: over 15 and up to 20 miles, £25.
Over 20 miles: we do not deliver there by default. Send us an enquiry and we will tell you if we can help and what it would cost.
Delivery is free on orders over £300 before VAT, in every zone.
Someone must be at the address to receive the order during the slot. If we cannot hand it over, we will phone you. [Say what happens if nobody is reachable, for example the order is left with reception, or it is not refunded.]
We aim to arrive within your slot, but traffic and weather can cause delays. We will tell you as soon as we know.
Dietary requirements and allergens
Tell us about any dietary or allergy requirement when you order. This is how it works:
You enter the requirement at checkout and pay as normal.
We flag your order and email you to confirm whether we can meet the requirement.
Your order is not confirmed until we have replied.
If we cannot meet the requirement, we will refund you in full.
Each product page lists the allergens it contains. Our food is prepared in a kitchen that handles [the 14 major allergens, delete any that never enter the kitchen], so we cannot guarantee that any item is completely free of an allergen or its traces.
If you or a guest has a severe allergy, please contact us before ordering so we can talk it through.
Changes, cancellations and refunds
We prepare your food to order, so changes and cancellations get harder as the delivery date gets closer.
Changes and cancellations by you: free up to [2 working days] before your delivery date. Email [email address] with your order details. After that we will already have bought and started preparing your food, so we cannot refund it. [Proposal: confirm the cut-off you want.]
Reducing numbers: you can reduce the number of people up to [2 working days] before delivery, down to the minimum of 10. [Confirm.]
If we cannot deliver: if we cancel or cannot deliver, for example because of illness or severe weather, we will offer a new date or refund you in full.
If we cannot meet a dietary requirement: full refund, as set out above.
If something is wrong with your order: tell us within [24 hours] of delivery, with a photo if you can. Where the fault is ours, we will replace it, or refund the affected items.
How refunds are paid: to the card you paid with, within [14] days.
The 14-day cancellation right that applies to many online purchases does not cover food made to order or goods that spoil quickly. It also does not apply to business customers. Your other legal rights as a consumer are not affected.
Food safety, storage and our responsibility
Storage: once your order arrives, keep chilled items in a fridge at 5°C or below, and eat them by the date on the label or within [state period]. We cannot be responsible for food stored or served outside this guidance.
Our kitchen: [food hygiene rating / registration with West Sussex local authority, if you want to mention it].
Our responsibility: we are responsible for loss or damage caused by our failure to take reasonable care, up to the value of your order. For business customers, we are not liable for lost profit or other indirect loss.
What we do not limit: nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
Things outside our control: we are not responsible for delays or failures caused by events we could not reasonably control, such as severe weather, road closures or supplier failure. We will tell you as soon as we know, and refund anything we cannot deliver.
Complaints, privacy and general terms
Complaints: if something is not right, email [email address] and we will reply within [2 working days] and try to put it right.
Privacy: how we use your personal information is set out in our privacy policy at [link].
Changes to these terms: we may update them. The terms in force when you place your order are the ones that apply to it.
Law: these terms are governed by the law of England and Wales, and its courts have jurisdiction. If you live in Scotland or Northern Ireland, you may also bring a claim in your local courts.
If part of these terms cannot be enforced, the rest still applies.
